NY State Police Admit Mistake In Gun Confiscation.

Ooops!

Remember that guy who had his rights violated by New York and Cuomo’s onerous, rights-destroying legislation?

No due process. Numerous apparent privacy violations.

Gosh! That was a mistake!

WR2A has it.

New York’s SAFE Act – destroying the rights of law abiding citizens one at a time

After the slaughter at Newtown, some states rushed to enact strict gun control laws with much fanfare and claims that their latest infringements will stop another massacre.

We want to keep guns out of the hands of the violent and the mentally unstable, right?

We want to stop the wholesale slaughter of our children, right?

Right.

A permit holder and gun owner in New York recently found out he had lost his right to keep and bear arms.

By mail.

With no warning or adjudication of mental instability.

Why?

Because he once took medication for anxiety. The State Police sent him a simple little letter.

“Claiming that he had taken some psychotropic medications, and that he no longer could be eligible for the pistol permit,”

[...]

The permit holder lives in Amherst and [his lawyer] accompanied the man as he turned in his seven handguns used for target-shooting to Amherst Police.

“A law-abiding, honest, hard working professional, who never had one wit of scandal associated with him, criminal or otherwise. And they took his guns away,” Tresmond said.

Tresmond is one of the attorneys already suing the state over passage of the SAFE ACT, which at the time was the toughest gun control law in the country.

Tresmond says his client once took a prescribed medication for his anxiety but he is not mentally ill. The Amherst man ended his prescription use within the last year.

I have to pose a few questions given the information provided in the story.

How did New York State Police find out this man took medication? Did they delve into his medical records? Did they check his pharmacy? Did they cross check the names of registered gun owners with pharmacy records? Did they violate doctor-patient confidentiality? Did they have any cause to investigate this particular man? And how is forcing him to turn in his property at the point of a government gun without any adjudication of guilt or mental incompetence and without due process not a violation of his constitutional rights?

Apparently state law permits the suspension of a gun permit before the permit holder even gets a chance to state his or her case.

Removal of rights without any wrongdoing.

This is what the petty tyrant Cuomo wanted when he screeched about there being no need for a 10-round magazine to hunt deer.

This is what he wanted when he speechefied about safety and proudly signed into law some of the most odious, right-destroying legislation in the nation.

He wanted everyone (except his armed security) disarmed and helpless, and when the thugs continue to victimize the innocent, he and his boot licking despots in the state legislature will pass more laws to make themselves look useful in the eyes if the idiots who elect them.

They’re creating more work for themselves, painting themselves as crime-fighting heroes, even as they subjugate the very people from whom their power stems.

This is what your gun control laws will ultimately do, hoplophobes.

And when you scream that your other rights are being violated, there will be no one left out there with the will and the tools to defend what’s left of those rights.

Armalite Will Continue Sales to LEOs (WITH UPDATEY GOODNESS)

As I reported a few days ago, several firearms companies are telling New York State to suck it. They won’t sell to New York authorities. I applaud them. I believe the number is up to 12 now.

ArmaLite was conspicuously absent, so a concerned gun owner apparently sent an email inquiring about their sales policies and whether they were going to be altered in response to New York’s odious new law. The full report is here.

The response this person received was pretty rude.

Dear concerned gun owner,

First of all I would like to say thank you for filling my email with all this spam email.

Second, I am not sure where you got this blanket email from to send out as spam, but please stop it.

Third, The manufacture is not the one you need to convince.

You need to convince the law enforcement agencies and the common people about their mistake in electing these officials and have them removed. Again NOT the manufacture.

AR Stands for ArmaLite…

Respectfully,

Pat Raley
Master Armorer / Sales Rep.
ArmaLite, Inc.
P.O. Box 299
Geneseo, IL. 61254

As you can imagine, this was not well received by gun owners, and the response was… well… uproarious, to say the least.

ArmaLite responded on Friday.

The root of the matter is a HUGE series of inquiries by both email and telephone asking ArmaLite to cut off sales to New York and other states which deny its citizens the right to own our rifles, as several other firms have done. Some of the contacts have been duplicates of others and some were so redundant that they appeared to be spam. Many of them have been rude and I’m afraid one of my staffers thought that he was responding to a spammer and was more terse than he should have been. Once he realized what happened he came to me and apologized.

My purpose here is to pass on his apology from the corporate level and to answer the initial question: What is ArmaLite going to do?

ArmaLite is continuing a policy put into place when California first banned our rifles. That policy remains:

1. We will not sell to those states which deny it’s [sic.] honorable citizens the right to own ArmaLite’s [sic.].

2. We do not halt sales to individual officers even in problematic states. I am a former Police Officer myself, and the staffer who stimulated the recent anger is a currently serving one. We are well familiar with the fact that most rifles serving Police Officers are purchased by the officers themselves, and that they shouldn’t be punished for the actions of their political elite.

We consider sales to those sate subdivisions which are not engaged or potentially engaged with disarming its citizens. DNR and Forestry Departments, for instance, sometimes serve in remote areas that conceal drug farms and their officers deserve good hardware.

3. We will not sell to those lower political subdivisions that deny their honorable citizens the right to own ArmaLite’s [sic.]. Chicago, for instance, prohibits its citizens from owning ArmaLite’s [sic.] within the city limits so we make no effort to sell into that city. We have many friends on the Chicago Police Department and have continued to sell to them individually.

Our observation is that most County Sheriffs disagree with banning sales of our rifles and many publicly refuse to enforce such laws. We sell to those departments and to their Deputies, but will not sell to those County departments headed by Sheriffs who would deny their citizens the same rights.

In short, Americans need not worry that ArmaLite is selling to those who betray them.

Yeah, no. I’m worried.

While I appreciate ArmaLite’s principled stance in not selling to states that ban the ownership of their rifles for ordinary citizens, this strikes me as a bit dodgy.

The individual officers are still afforded their rights, while ordinary citizens are deprived of them. The individual officers still enforce these noxious laws, disarming, arresting, confiscating, etc. peaceable people. And yes, they’re just following orders. We know. Nonetheless, they get to freely exercise their Second Amendment rights, while ordinary citizens do not. And ArmaLite is facilitating this injustice by continuing sales to the “privileged,” while the rest of the population is prosecuted for owning the same product. (See: Nathan Haddad for more)

ArmaLite’s sales practices are its business. They’re welcome to make their business decisions as they see fit. They don’t want to lose the profits. I get that.

I, and I think scores of other gun owners, don’t want to do business with a company that holds the “authorities” to a lower standard than the rest of the citizenry. I don’t want to deal with a company that believes it’s perfectly OK to arm police, while the rest of its customers’ rights get violated, merely because it has a good relationship with law enforcement. And I don’t want to deal with a company that claims it’s not selling to those who betray Americans, while selling to those who may or may not support these odious laws (after all, I doubt they take a survey asking their law enforcement customers whether or not they approve of the assault weapons ban passage) and who definitely enforce them regardless.

No thanks, ArmaLite. Have a nice day.

UPDATE: Thanks to commenter Lion of Gray for directing me to this site, which details those firearms companies who have stood on principle and refused to sell their products to the authorities in states that have infringed upon the citizens’ rights.

Know your friends and your enemies. Know them well.

Guns Save Lives – Gun Laws Ruin Them

Every day we see and hear stories about how law-abiding citizens protect themselves and their lives with firearms. Guns are an inescapable fact of our existence – tools we use in combat – tools we use to defend ourselves and our loved ones – tools we use to protect our nation and our rights from violence.

It also seems like every day, we have hoplophobic douchenozzles making bigger efforts to ruin our lives with more gun control – in the name of the childrens, of course – using Sandy Hook as an excuse to push their unconstitutional, authoritarian agendas.

Why do I say “ruin our lives?”

Because it’s true, and its being done very deliberately.  Lives are being ruined, and I get the feeling that it is being done to set an example… to discourage opposition… and to eventually quell dissent and the will to fight.

Remember the story of David Gregory and SPC Adam Meckler? Both “guilty” of the same “crime.” But Meckler was arrested, cuffed, prosecuted, and ultimately forced to accept a plea bargain that will likely impact the rest of his life in order to avoid a lengthy and expensive court battle. Meanwhile media maggot Gregory walked away with nary a warning because he’s buds with some important folks.

Remember the story of Nathan Haddad? He is the military veteran who was arrested in New York for possession of some standard rifle magazines. He is a dad, a vet, a volunteer and a peaceful member of society. Been wondering what happened to him?

Emily Miller reports Haddad has been offered a “deal.”

The district attorney for Jefferson County, N.Y., offered Sgt. Haddad, now a civilian employee at Fort Drum, N.Y., a deal that would require him to plead guilty to five Class A misdemeanors to avoid going to jail. Sgt. Haddad has several weeks to decide whether to go to trial.

My first reaction was that I’m going to still be branded as a criminal and probably lose my job,” he told The Washington Times. “The military doesn’t consider a 30-round magazine a weapons system — it is just a component of a weapons system.”

Quite the “deal,” eh? Scum like Gregory get to walk around without even a slap on the wrist, even getting to interview the President, while honorable veterans who have served their country get to walk away with criminal records.

Worse yet, Haddad is being ruined financially.

Since his arrest, Sgt. Haddad has sold all his property, including his AR-15 rifle, to pay his lawyer. His New York state permit to carry a gun was taken away, and the sheriff’s office confiscated his pistols. His brother, Michael Haddad, has started a legal-defense fund.

But that doesn’t seem to matter to the swine in charge in New York. In their zeal to destroy the will of the people to fight, they destroy lives.

My theory is that this is precisely their goal:  to quell the desire of the populace to oppose these draconian measures – to force people to think twice before standing up to them – to crush the will to resist. After all, if your job, your clearance and your property are at stake, how willing would you be to sacrifice them all for your rights? If you see the “privileged” being treated with more deference than ordinary citizens, watch helplessly as innocent people are ruined, while entitled swine get to interview POTUS, how willing would you be to take on the system? The tyrannical swine are betting on your unwillingness, and they’re making examples of stellar individuals while giving a wink and a nod to maggots like David Gregory.

Just my thoughts.

Privileges, Not Rights

Not only did New York legislators ram an ill-advised, twisted, tyrannical, fucktarded gun control law down the throats of its citizens and deprive them of some of the most effective defensive tools on the market today, but now, taking a line out of the ObamaCare playbook, they are also trying to force gun owners to purchase insurance.

Forcing. Private. Individuals. To buy. A product.

“Any person in this state who shall own a firearm shall, prior to such ownership, obtain and continuously maintain a policy of liability insurance in an amount not less than one million dollars specifically covering any damages resulting from any negligent or willful acts involving the use of such firearm while it is owned by such person,” the measure, dubbed S2353, reads.

And if you refuse? Well, “Such an occurrence ‘shall result in the immediate revocation of such owner’s registration, license and any other privilege to own such firearm.’”

This is instructive, boys and girls. We already knew that the ignorant cretins that run the shithole that is New York have no problem infringing on your rights. However, as you can see from this particular proposal, your rights protected by the Second Amendment to the United States Constitution are merely “privileges” for their purposes.

Privileges, not rights.

Authoritarian swinery duly noted. Again.

Such liability insurance will cost gun owners as much as $2000 per year. Now, tell me something – how many poor folks living in dangerous neighborhoods, who may need a tool of self-defense, can afford an additional $2000 per year after they have already purchased a firearm at a jacked up price due to mandatory gadgets and bureaucracy meant to make the firearm “safe,” by “well-meaning” politician assdrips?  How many won’t be able to purchase a tool with which to protect their families because of the onerous extra associated costs?

I’m sure Demtard Assemblyman Felix Ortiz couldn’t give a flying rat’s fuck. I’m fairly sure he lives in a decent neighborhood, where he doesn’t have to worry about protecting himself and his family too much. Meanwhile, the people he seeks to disarm will be rendered defenseless by his efforts to make firearms cost prohibitive. Why do you hate poor people, Felix?

It is time for firearms manufacturers to start leaving New York. And it’s time for gun owners to follow suit. It has become nothing but a third-world banana republic with tyrannical politicians imposing their will on the very people whom they’re supposed to be serving!
